GENERAL TERMS OF SALE
1. Scope
1.1 These General Terms of Sale apply to all offers, sales agreements, and deliveries of products by Anamon BV(hereinafter “Anamon”), whether placed via the website https://www.anamon.be, through electronic communication, or by any other means.
1.2 These Terms apply to both business customers (B2B) and consumers (B2C). Where specific rights or obligations apply only to consumers, this will be explicitly indicated.
1.3 By placing an order, the customer acknowledges having read and accepted these Terms. Any general or specific terms proposed by the customer are excluded, unless expressly accepted in writing by Anamon.

3. Orders and Contract Formation
3.1 Product offers on the Website are non-binding and subject to availability.
3.2 A sale is only binding upon written or electronic confirmation from Anamon. We reserve the right to refuse any order without stating a reason, particularly in cases of suspected fraud, incorrect pricing, or overdue payments.
3.3 For online purchases, the contract is concluded once the customer receives the order confirmation by email.
4. Products
4.1 Anamon products are made from high-quality materials. Minor variations in color, texture, or dimension due to production tolerances or material characteristics (e.g. fabric grain or coating nuance) do not constitute a defect.
4.2 Product descriptions, technical information, and images on the Website or in promotional materials are illustrative only and not contractually binding.
5. Prices and Payment
5.1 All prices on the Website are in euros and include VAT (for B2C customers) unless explicitly stated otherwise.
5.2 Any additional charges such as shipping or special packaging will be indicated separately during the ordering process.
5.3 Payment must be made in full before shipment, unless otherwise agreed in writing. For B2B clients, specific terms may apply as indicated on the invoice.
5.4 In case of non-payment by the due date, interest of 1.5% per month is payable automatically, without prior notice. Additionally, a fixed compensation of 10% of the outstanding amount, with a minimum of €50, may be charged for administrative collection costs.
6. Delivery
6.1 Delivery times stated on the Website or in correspondence are indicative and not binding. Delay in delivery shall not entitle the customer to cancel the order or claim damages.
6.2 Products are delivered to the address provided by the customer. The risk passes to the customer upon delivery.
6.3 Anamon reserves the right to make partial deliveries, which may be invoiced separately.
7. Right of Withdrawal (Consumers Only)
7.1 Consumers purchasing via the Website have the right to withdraw from the sale within 14 calendar days of the delivery date, without providing a reason.
7.2 To exercise this right, the consumer must notify Anamon in writing via email or using the standard withdrawal form (available upon request).
7.3 Products must be returned in their original, unused condition and packaging within 14 days of notification. The cost and risk of return shipping are borne by the consumer.
7.4 Upon proper return, Anamon will reimburse the original payment within 14 days of receiving the returned goods.
7.5 The right of withdrawal does not apply to personalized or made-to-order items.
8. Complaints and Warranty
8.1 For consumers, products are covered by the statutory 2-year warranty against manufacturing defects. For B2B clients, the warranty period is 1 year unless otherwise stated.
8.2 The customer must inspect goods immediately upon delivery. Visible defects must be reported within 48 hours; hidden defects within 8 days of discovery.
8.3 Warranty claims must be submitted in writing and include proof of purchase and, where applicable, photos of the issue.
8.4 The warranty is limited to repair or replacement of the defective product or component, at Anamon’s discretion. It does not cover misuse, weather damage, neglect, or normal wear and tear.
9. Retention of Title
9.1 All products remain the property of Anamon until full payment has been received. The customer assumes responsibility for the goods upon delivery.
9.2 In case of non-payment, Anamon reserves the right to reclaim the goods at the customer’s expense. Any advance payments may be retained as indemnity.
10. Liability
10.1 Anamon shall not be liable for any indirect or consequential damages, including but not limited to loss of revenue, loss of use, or reputational harm, unless caused by willful misconduct or gross negligence.
10.2 Nothing in these Terms excludes or limits Anamon’s liability where such limitation is not permitted under applicable law.
11. Force Majeure
11.1 Anamon is not liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to strikes, accidents, fires, floods, government measures, or supply disruptions.
11.2 In such cases, Anamon may suspend or cancel the sale without liability.
12. Intellectual Property
12.1 All designs, visuals, logos, texts, and content relating to Anamon products or the Website are the exclusive property of Anamon BV and are protected by intellectual property rights.
12.2 Any reproduction, distribution, or commercial use without written permission is strictly prohibited.
13. Applicable Law and Jurisdiction
13.1 These Terms are governed exclusively by Belgian law.
13.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Antwerp, unless mandatory legal provisions prescribe otherwise for consumer disputes.
